TV WEEK Logie Awards – Most Popular Voting Competition
Terms and Conditions
Information on how to vote and prizes forms part of these terms and conditions. By voting, you agree to be bound by these terms and conditions. These terms and conditions are to be read in conjunction with the terms and conditions applicable to your use of the TV Week Logie Awards website at tvweeklogieawards.com.au (“Website”). Separate requirements will apply for ‘live voting’ for those “Most Popular” categories that have ‘live voting’.
The Competition commences on 04/03/19 and ends at 11.59pm AEST on 31/03/19 (“Voting Period”).
If you are under the age of 18 years, you must have the prior consent of your parent or legal guardian to enter. Entry is open to Australian residents. Employees of the Organiser and their immediate family and other persons associated with the Competition are ineligible to enter.
Voting: You can vote for a nominee in each of the “Most Popular” categories for the TV WEEK Logie Awards by, during the Voting Period, going to the Website and following the voting instructions (including by providing your full name, mailing address, email address, date of birth and daytime telephone number). You may only vote for one nominee in each category and, out of the twelve “Most Popular” categories, you must vote in at least the four compulsory categories.
You may only vote once.
You warrant that you have not received any incentive in relation to the casting of your vote other than an incentive offered by the Organiser.
Entry into the Competition: When you submit a valid vote, you will automatically receive one entry into the Competition. If, at the time of voting, you provide a valid TV WEEK code word (which can be found in all issues of TV WEEK on sale during the Voting Period), you will receive four additional entries in the Competition.
The Organiser reserves the right, at any time, to verify the validity of votes and voters (including a voter’s identity, age and place of residence) and to disqualify any voter who submits a vote that is not in accordance with these terms and conditions or who tampers with the voting process, including by: (a) corrupting or attempting to corrupt the administration, security, fairness, integrity or proper conduct of the voting mechanism or process (including a Website voting mechanism); or (b) using an automated process to submit a vote or votes. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights. Any vote that the Organiser deems otherwise inappropriate will be ineligible and will be discarded.
The Organiser accepts no responsibility for any votes not received by the Organiser or delays in the delivery of votes due to any reason whatsoever. A vote will only be counted as being received once it has been received by the Organiser and not when it was sent. The Organiser accepts no responsibility for late, lost or misdirected votes.
Access to the voting application on the Website may be limited on some mobile, tablet and other portable devices. It is your responsibility to check the functionality of the voting application on your device prior to voting. The Organiser accepts no responsibility for any technical issues that result in the failure of the functionality of the voting application or Website or for any inability to access the Website at the time you intend on doing so.
Any costs associated with voting, including data costs, are the voter’s responsibility.
Draw and award of prize
The draw will take place at Roy Morgan Research, 386 Flinders Lane, Melbourne, Victoria on 08/04/19 at 10am AEST.
On the draw date, the Organiser will conduct a random draw to determine the winner from valid entries. The Organiser will also draw reserve winners and record them in the order drawn in case the original person drawn or subsequent reserve is deemed ineligible. If this process does not result in the prize being awarded, it will be awarded in the unclaimed prize draw as set out below.
The first valid entry drawn from all valid entries received will win the following prize:
two return economy flights from the winner’s nearest Australian capital city to Gold Coast valued at up to $2,000 (including airport and airfare taxes) (depending on point of departure);
one night’s twin share accommodation at The Star Gold Coast on the night of 30/06/19 valued at up to $319;
the opportunity for two people to walk the red carpet at the 2019 TV WEEK Logie Awards and to attend the official awards ceremony at The Star Gold Coast; and
The TOTAL PRIZE POOL IS VALUED AT UP TO $2,319 (including GST). If the winner is a resident of Queensland, the prize does not include the airfare component and no alternative prize of cash will be awarded in lieu of the airfare component.
The winner will be notified by telephone and in writing within 7 business days of the draw using the contact details provided with their vote. The winner’s name will be published in the issue of TV WEEK magazine on-sale on 29/04/19. In order to be eligible to take the prize, the winner must verbally confirm when called by the Organiser that they can take the prize on the relevant dates and will comply with these terms and conditions.
The winner must take the prize as offered. The prize, or any unused portion of the prize, is not exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer.
If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on the winner’s behalf. It is the responsibility of the winner’s parent or legal guardian to prove their parental or guardianship status at the time of winner notification. If a person incorrectly represents themselves to be a winner’s parent or legal guardian, that person will be liable for all costs associated with re-delivering or re-awarding the prize (including but not limited to any administrative fees incurred by the Organiser). Where relevant, the Organiser is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Organiser is not responsible for determining any other delivery details or taking directions that relate to any ongoing family law negotiations or determinations. These are the responsibility of the winner and their respective parent or legal guardian.
The winner hereby agrees to be interviewed, photographed and filmed at any time during the redemption of the prize for a feature on this promotion to be developed and featured in TV WEEK magazine and its associated website or social media pages (or any other form of media the Organiser deems suitable) without further remuneration or reference to the winner. The creation or use of any such feature (including but not limited to creative control of the feature) is at the discretion of the Organiser.
If the prize, or part of the prize, is unavailable, the Organiser may substitute an alternative prize to substantially the same recommended retail value and/or specification, subject to any written direction from the various regulatory authorities.
The Organiser is neither responsible nor liable for any loss or damage suffered in the event that the 2019 TV Week Logie Awards is postponed, cancelled, rescheduled or relocated for any reason.
If the prize remains unclaimed by 10:00am AEST on 27/05/19, an unclaimed prize draw will be held on that date at the same time and place as the original draw in order to award the prize, subject to any directions from a regulatory authority. A winner from this draw, if any, will be notified in writing within two days of the re-draw by email and telephone using the contact details in their entry and their name will be published in the issue of TV WEEK magazine on-sale 10/06/19.
The prize will be delivered to the nominated address of the winner, provided that address is in Australia. The Organiser is not responsible or liable for any delay or failure in delivery of the prize by a third party or for any damaged caused to the prize during delivery.
The prize is subject to the standard terms and conditions of individual prize and service providers. Without limitation, the tickets to the awards ceremony are subject to the venue’s terms and conditions of entry, including any applicable age restriction. The Organiser and venue management reserve the right to eject the winner (and/or his or her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
The Prize must be redeemed in full and as a package to coincide with the 2019 TV WEEK Logie Awards. All components of the prize are subject to availability at the time of booking. If, for any reason, the prize is not redeemed to coincide with the 2019 TV WEEK Logie Awards, the prize will be forfeited by the winner and neither cash nor any other prize will be awarded in lieu of the prize being forfeited.
Hotel accommodation is subject to availability and change without notice.
Changes to flight schedules may require additional overnight accommodation and associated expenses at the commencement of, during or on completion of the travel. Such accommodation and expense is at the winner’s expense.
The opportunity to attend the official awards ceremony includes two seats at a table (meal and drinks included) at the 2019 TV WEEK Logie Awards. The location of the table will be determined by the Organiser at its discretion and the winner will be notified of that location at the ceremony. The double pass is a general admission only and does not include participation in any restricted access components of the awards.
Unless expressly stated in these terms and conditions, the winner (and their companion) is responsible for all ancillary expenses associated with the redemption and enjoyment of the prize, including spending money, meals (except the meal at the official awards ceremony), drinks, travel to and from the departure point, laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges and travel insurance. Any extension to the duration of the travel beyond that provided for as part of the prize is at the winner’s sole expense and subject to availability at the time of booking. Travel insurance is highly recommended to protect against additional costs incurred in the event of unforeseen circumstances.
The winner acknowledges and accepts that driving, travel and other activities comprising the prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Organiser does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.
The winner (and any companion) must travel on the same dates, depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. It is the winner’s responsibility to ensure that they have all relevant documentation in order to travel. All elements of the prize must be taken together within the one trip.
The prize is subject to the standard terms and conditions of the prize provider and of any associated travel and accommodation providers and the winner (and their companion) must comply with such terms and conditions.
It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel.
Prize values are based upon the full fare prices as at 09/01/19. The Organiser accepts no responsibility for change in prize value between now and the prize redemption date.
The winner (and their companion) must sign any legal documentation as and in the form required by the Organiser in its absolute discretion, including but not limited to a legal release and indemnity form.
The winner (and their companion) must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Organiser and its partners exclude any legal liability or responsibility for incidents that occur or activities engaged in by the winner or their guest during participation in the prize.
The Organiser’s decision in relation to all aspects of the Competition is final and no correspondence will be entered into.
In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Organiser may, subject to relevant state and territory rules and regulations, cancel, terminate, modify or suspend the Competition.
The Organiser reserves the right to keep all voting results confidential.
You acknowledge that the political, professional and personal views of the nominees for the TV WEEK Logie Awards are in no way a reflection of the Organiser’s views.
You acknowledge that the Organiser may disqualify any nominee for a TV WEEK Logie Award and that, in such circumstances, any vote by you for that nominee will be forfeited.
Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar applicable laws (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Organiser (including its officers, employees and agents) excludes all liability (including negligence) for any: (a) personal injury arising in any way out of the Competition; or (b) any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (i) the Competition; (ii) any technical difficulties or equipment malfunction (whether or not under the Organiser’s control); (iii) any theft, unauthorised access or third party interference; (iv) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Organiser) due to any reason beyond the reasonable control of the Organiser; (v) any variation in prize value to that stated in these terms and conditions; (vi) any tax liability incurred by a winner or entrant; or (vii) use of the prize.
Subject to the Non-Excludable Guarantees, the Organiser makes no representations or warranty as to the quality, suitability or merchantability of any of the goods or services offered as a prize.
