Terms and Conditions of Entry

  1. Information on how to enter form part of the Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is open to all permanent residents of Australia who purchase the relevant issue of TV WEEK. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter. Employees and their immediate families of the Promoter and its agencies and companies associated with the promotion are ineligible to enter.
  3. To enter, Puzzles Entrants must either enter via:
  • Phone: By calling the relevant telephone number as per Table A and as published in TV WEEK. Eligible 1900 participants will be required to follow the prompts and provide their name, address, postcode, telephone number and correct puzzle answer/s to complete their entry.

  • SMS: By texting the relevant SMS number as per Table A and as published in TV WEEK. Eligible SMS participants will be required to SMS the correct puzzle answer, their name, address, postcode in 160 characters to complete their entry. If SMS exceeds 160 characters the entrant can leave off address and postcode and if drawn as a winner, TV WEEK will contact the winner and request full address details for prize delivery.
  • Mail: Official entry coupon as published in TV Week.  Coupon entries must be sent in a separate envelope to “TV WEEK Puzzles Issue XX” with the relevant issue number to  GPO Box 5528, SYDNEY 2001 providing their name, address, postcode, telephone number and correct puzzle answer to complete their entry.

All entries must be received by 23:59 (AEST/AEDST) as per the relevant close dates in Table B.

Maximum cost of 190 call is 55c. Calls from payphones and mobile phones may attract a higher rate. Premium SMS cost is 55c. Entrants must have premium service access. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. Persons under the age of 15 must obtain bill payers permission before calling a 1900 number or sending a premium SMS. 1900 and SMS Service Provider is: Engage Australia.   1. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per person per puzzle per TV Week issue (per original entry form for mail entries); and (b) each entry must be submitted separately and in accordance with entry requirements.
  2. Inaudible, incomplete or incomprehensible entries will be ineligible.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS /190 call costs). Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Entrants must retain each original TV WEEK magazine for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
  5. The competition commences on the open dates as per Table B at 00:01 (AEST/AEDST when applicable) and concludes on the close dates as per Table B at 23:59 (AEST/AEDST when applicable). All winners will be notified by mail within Seven (7) working days of the draw, and winners of prizes valued at over $250 will be published in TV Week magazine on-sale dates as per Table C.

  1. Promoter’s decision is final and no correspondence will be entered into. Prizes cannot be transferred.
  2. Only one (1) prize per household per month from the draw dates as per Table C, excluding residents of ACT and SA.
  3. The draw for the winners from the Phone and SMS entry mechanic will take place on the draw dates as per Table C at 9.00am (AEST/AEDST when applicable) at Engage Australia, Level 8, 56 Clarence Street, Sydney NSW 2000. The draw for the winners from the mail coupons will take place on the draw dates as per Table C at 9.00am (AEST/AEDST when applicable) at Direct Response Australia Unit D 65 Reserve Road, Artarmon, NSW 2064.
  4. The first number of valid and correct entries drawn for each Puzzle (as per the below) will win the prize/s for that Puzzle.

For all Phone (190) and SMS entries prizes are as follows:

  • Puzzle 1 (Word Search): Three (3) winners will win $50 – awarded in the form of a cheque made in favour of the winner.
  • Puzzle 2 (Picture Pointer): One (1) winner will win $250 – awarded in the form of a cheque made in favour of the winner.

All Money prizes will be awarded in the form of a cheque made in favour of the winner.

For all Coupon (mail) entries prizes are as follows:

  • Puzzle 1 (Word Search): Three (3) winners will win $50 – awarded in the form of a cheque made in favour of the winner.
  • Puzzle 2 (Picture Pointer): One (1) winner will win $250 – awarded in the form of a cheque made in favour of the winner.

The total prize pool for each individual draw period is valued at $800.00 (including GST). Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

  1. The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
  2. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
  3. The Promoter shall conduct such further draws as may be deemed necessary at Direct Response Australia Unit D 65 Reserve Road, Artarmon, NSW 2064 pending method of entry as per the second chance draw dates in Table D at 9.00am (AEST/AEDST when applicable) to distribute any prizes unclaimed by that date, subject to any written direction from any regulatory authority. Winners, if any, will be notified by mail within seven (7) working days of the draw and winners of prizes valued at over $250 will have their names published in TV Week on-sale dates as per Table D.

  1. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
  2. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
  3. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
  4. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
  5. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
  6. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  7. Unless otherwise due to fraud or ineligibility under these terms and conditions, all valid prize claims in excess of the advertised prize pool will be honoured. All advertised instant prizes will be awarded.
  8. Printing and other quality control errors will not invalidate an otherwise valid prize claim. In the event of a query as to the validity of an entry, the judges will determine whether or not the entry is to be deemed valid, taking into consideration all mitigating circumstances and knowledge available to them at the time of the judging. No correspondence will be entered into.
  9. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  10. By entering the promotion via SMS an entrant consents to the Promoter using the their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of your entry in the promotion.
  11. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
  12. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
  13. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.
  14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

 

  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Privacy:

  1. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
