TERMS & CONDITIONS

1.

Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in the Bauer Media Rewards travel incentive offer (“Offer”) is deemed acceptance of these Terms and Conditions. This Offer is not valid in conjunction with any other offer.

2.

The Offer commences at 9:00 am AEST on the date the Advertiser (defined below) receives the Offer from an authorised representative of Bauer Media Pty Limited ACN 053 273 546 (“Bauer”) and closes at 17:00 pm AEST on 30 September 2016 (the “Offer Period”). 3.

For the purposes of these Terms and Conditions:

a. “Advertiser” means any person who places a booking for the purchase of advertising opportunities between April 2016 and September 2016 cover dates, including advertorials in or on Bauer Platforms;

b. “Bauer Advertising Terms” means the terms and conditions which govern the supply of advertising services by Bauer, as updated from time to time and published at http://www.bauer-media.com.au/terms/advertising-terms;

c. “Bauer Platforms” means the print and digital platforms operated by Bauer, excluding Bauer Trader media and Bauer Custom Media platforms;

d. “Current Advertiser” means an Advertiser who placed a booking in or on Bauer Platforms between April 2015 and September 2015.

e. “Minimum Spend” means the minimum spend an Advertiser must commit for the purchase of advertising opportunities on the Bauer Platforms between April 2016 and September 2016 cover dates, as follows:

i. for Current Advertisers – $60,000 AUD increased spend year-on-year (YOY); and
ii. for New Advertisers - $60,000 AUD,

calculated based on the applicable rate for an advertising booking on the relevant Bauer Platform, excluding all associated costs including but not limited to production costs. For clarity, where an agency is acting on behalf of multiple advertising clients, the Minimum Spend requirement is calculated on a per client basis;

f. “New Advertiser” an Advertiser who has not placed a booking in or on Bauer Platforms in the 13 months prior to the commencement date of this Offer; and

g. “Travel Incentive” means:

i. two (2) x return economy flights, departing from either Sydney or Melbourne (whichever departure point is closest to the Advertiser) and returning from the travel destination in Asia to be determined by Bauer, on dates and at times to be determined by Bauer;
ii. seven (7) nights’ twin-share five (5) star accommodation in the travel destination in Asia to be determined by Bauer;
iii. payment of each traveller’s applicable airport taxes and visa costs; and
iv. airport transfers in the travel destination,

valued at $10,000 (including GST).

To be eligible to claim the Travel Incentive, an Advertiser must contact Bauer and commit the Minimum Spend (as applicable) during the Offer Period. For clarity, only advertising bookings which are to be published on the Bauer Platforms between 1 April 2016 and 30 September 2016 will be taken into account for the purpose of determining whether an Advertiser has achieved the Minimum Spend, (hereafter referred to as “Eligible Advertisers”). For the avoidance of doubt, if advertising bookings are placed by an agency acting on behalf of an Advertiser, Bauer may designate either the Advertiser or the agency as the Eligible Advertiser for the purpose of claiming the Travel Incentive Any request to transfer the Travel Incentive between an agency and Advertiser or vice versa will be determined in Bauer’s absolute discretion. Only the Eligible Advertiser will be eligible to claim the Travel Incentive. If the Eligible Advertiser is a direct Advertiser, the Travel Incentive will be awarded in the name of two (2) representatives from Eligible Advertiser determined by Bauer in its sole discretion. If the Eligible Advertiser makes bookings with Bauer through an agency, the agency must nominate two (2) representatives from the Advertiser.

If Bauer requires any further information, a Bauer representative will contact the Eligible Advertiser via email.

6.

The names and details of those representatives must be notified to Bauer at MKrueckel@bauer-media.com.au no later than 5:00 pm AEST on 30 September 2016. The Eligible Advertiser must ensure the nominated representatives are available to travel on the dates notified by Bauer. The Promoter will confirm the exact dates of travel.

7.

Eligible Advertisers are eligible to claim one (1) Travel Incentive only. The Travel Incentive is not transferable. If the nominated representatives cannot redeem the Travel Incentive on the dates notified by Bauer, the Travel Incentive will be forfeited by that Eligible Advertiser.

8.

If an Advertiser undergoes a merger with another corporation or business or is acquired by another corporation or business during the Offer Period, Bauer reserves the right to review the Minimum Spend as it deems appropriate.

9.

If an Advertiser:

a. breaches any of these Terms and Conditions or the Bauer Advertising Terms;
b. supplies any misleading information or makes any misrepresentations to Bauer or its agents in connection with this Offer;
c. becomes insolvent; unable to pay its debts as due; enters into an arrangement with creditors other than for solvent reorganization; or has a receiver, administrator or liquidator appointed over some or all of its assets,

Bauer may disqualify that Advertiser.


10.

The Travel Incentive is subject to availability at the time of booking. Bauer reserves the right, in its discretion, to change the dates, destinations and activities of the Travel Incentive or substitute the Travel Incentive or part of the Travel Incentive with an alternative reward to equal value and/or specification at any time. If changes result in an Eligible Advertiser being unable to claim the Travel Incentive, the Eligible Advertiser will be deemed to forfeit the Travel Incentive.

11.

The Travel Incentive must be taken in full, as a package as offered. It is a condition of accepting the Travel Incentive that the Eligible Advertiser’s nominated representatives must comply with all terms and conditions of third party suppliers, including any requirement to provide credit card details upon arrival at the accommodation for incidental costs during their stay.

12.

If the Eligible Advertiser is part of a frequent flyer program of the airline determined by Bauer, the Eligible Advertiser may use its own points to upgrade the Eligible Advertiser’s representatives or otherwise the Eligible Advertiser may elect to upgrade the Eligible Advertiser’s representatives at the Eligible Advertiser’s expense. Frequent flyer points may be accrued (if applicable).


13.

The Travel Incentive does not include:

a. connecting flights or other transport to or from Sydney or Melbourne international airport (whichever departure point is closest to the Advertiser);
b. travel insurance;
c. any costs associated with, or the organisation of, obtaining valid passports;
d. any excess baggage expenses;
e. any costs associated with, or the organisation of, obtaining medical advice or hospital care prior to or during travelling overseas or obtaining any recommended vaccinations and immunisations in the manner required prior to travelling;
f. day to day costs while in the travel destination including without limitation food and drink costs, room service, use of the mini bar and telephone or internet costs; and
g. any incidental or additional costs not expressly stated as part of the Travel Incentive in these Terms and Conditions,

And it is the Eligible Advertiser’s responsibility and cost to obtain such ancillary services.


14.

A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It is the responsibility of the Eligible Advertiser to ensure the Eligible Advertiser’s representatives have the required travel documentation.

15.

Any extension to the Travel Incentive is at the Eligible Advertiser’s sole cost and expense and subject to availability at the time of booking.

16.

The Travel Incentive is valued in Australian Dollars, inclusive of GST and Bauer takes no responsibility for variation in Travel Incentive value. All values in these Terms and Conditions are correct as at 19 February 2016. The Travel Incentive is not transferable, exchangeable or redeemable for cash. No elements of the Travel Incentive can be exchanged for travel or accommodation in other destinations.

17.

The Promoter does not accept liability or responsibility for any Commonwealth fringe benefits tax, state payroll tax or any other liability of any kind, excluding GST, (“Tax”) which is or may be imposed in relation to the Travel Incentive. Any Tax liability in connection with the Travel Incentive is the responsibility of the Eligible Advertiser. The Eligible Advertiser should seek independent financial advice prior to acceptance of the Travel Incentive.

18.

Bauer will not be liable for any voucher, ticket, pass or letter which forms part of the Travel Incentive and which is lost, stolen, forged, damaged or tampered with in any way.

19.

If the Eligible Advertiser does not redeem the Travel Incentive at the time notified by Bauer then the Travel Incentive will be forfeited and cash will not be awarded in lieu of the Travel Incentive.

20.

Bauer may discontinue the Offer at any time in its absolute discretion without prior notice. If this occurs, Bauer will not be liable to any Advertiser for the suspension or termination of the Offer.

21.

Bauer may change these Terms and Conditions at any time by providing reasonable notice to Advertisers by using the email addresses used by Bauer to communicate the Offer to each Advertiser. Changes may include, but are not limited to: changes to the Travel Incentive; the dates and/or time of travel; the destination of travel; and the accommodation.

22.

If the Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Bauer, Bauer reserves the right in its sole discretion, to the fullest extent permitted by law to disqualify an Advertiser or to modify, suspend, terminate or cancel the Offer, as appropriate.

23.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).

24.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Bauer (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including property damage or loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Bauer’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in Travel Incentive value to that stated in these Terms and Conditions; (d) any tax liability incurred by an Eligible Advertiser or nominated representative of an Eligible Advertiser; or (e) redemption of the Travel Incentive.

25.

The Promoter collects personal information (“PI”) in order to conduct the Offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, travel package suppliers and, as required, to Australian regulatory authorities. Participation in the Offer is condition on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in Bauer’s privacy policy, Bauer may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Advertiser. Advertisers should direct any request to opt out, access, update or correct PI to Bauer and direct any complaints regarding the treatment of their PI according to the privacy policy.
